NCLR and GLAD Refute Trump’s Bogus Attempt to Disguise His Transgender Military Ban  

Washington, D.C.—The National Center for Lesbian Rights (NCLR) and GLBTQ Legal Advocates & Defenders (GLAD) today struck back at the Trump Administration’s latest attempt to enforce the Trump-Pence transgender military ban. NCLR and GLAD filed a brief opposing the government’s request to the United States Court of Appeals for the District of Columbia to dissolve the preliminary injunction in Doe v. Trump. In the brief, NCLR and GLAD shoot down the Trump administration’s argument that the implementation plan developed by Secretary Mattis is a “new” policy rather than the same transgender ban President Trump ordered.

Con nai was the first lawsuit to challenge the Trump-Pence transgender military ban and won the first preliminary injunction halting the ban. On December 10, attorneys on both sides will argue this issue before the D.C. Circuit Court of Appeals. To secure an order keeping the ban from going into effect, NCLR and GLAD successfully demonstrated that the ban is likely to be held unconstitutional, and that thousands of transgender troops would suffer irreparable harm from the ban. Three other federal district courts have also issued preliminary injunctions blocking the ban.

“In direct response to President Trump’s orders, the military has produced an implementation plan that has the purpose and effect of ridding the military of transgender people from service,” said GLAD Transgender Rights Project Director Jennifer Levi. “The military’s own research on this topic shows that a ban weakens military strength. Transgender people have been courageous warriors. They have served on the front lines. The Trump-Pence administration owes them a debt of gratitude, not this kick in the teeth.”

“Secretary Mattis was ordered to implement the President’s ban, and that’s what he did,” said Giám đốc pháp lý của NCLR Shannon Minter. “Four federal courts have independently concluded that the ban is based on discrimination, not military needs, and that enforcing it would undermine our national security by excluding qualified individuals simply because they are transgender. The government has failed to show any reason for the D.C. Court of Appeals to reverse that conclusion and permit this harmful policy to go into effect.”

While the administration’s appeal on the dissolution of the injunction is heard at the D.C. Circuit Court of Appeals, the case is proceeding in the federal district court where GLAD and NCLR continue to push the administration to turn over documents it has withheld from discovery.

Ngày 9 tháng 8 năm 2017: NCLR và GLAD đã nộp đơn Doe kiện Trump, vụ kiện đầu tiên được đệ trình để ngăn chặn lệnh cấm, thách thức tính hợp hiến của nó và yêu cầu tòa án ban hành lệnh cấm sơ bộ trên toàn quốc để ngăn chặn lệnh cấm có hiệu lực trong khi vụ án đang được xét xử tại tòa.

Ngày 25 tháng 8 năm 2017: Tổng thống Trump đã ban hành bản ghi nhớ yêu cầu Bộ trưởng Quốc phòng James Mattis đệ trình “kế hoạch thực hiện” lệnh cấm trước ngày 21 tháng 2 năm 2018. Bộ trưởng Mattis đã đệ trình bản ghi nhớ này (Kế hoạch Mattis và báo cáo của hội đồng) cho Tổng thống Trump vào ngày 22 tháng 2 năm 2018.

Ngày 30 tháng 10 năm 2017: Tòa án Quận Hoa Kỳ tại Quận Columbia đã phán quyết rằng Doe kiện Trump nguyên đơn đã xác định được khả năng thành công khi cho rằng lệnh cấm của Tổng thống Trump vi phạm quyền bảo vệ bình đẳng, rằng nguyên đơn sẽ bị tổn hại không thể khắc phục nếu không có lệnh cấm sơ bộ để chấm dứt lệnh cấm, và rằng lợi ích công cộng và sự cân bằng khó khăn đã nghiêng về việc cấp lệnh cấm tạm thời và tạm dừng lệnh cấm trong khi tòa án thụ lý vụ án.
